Information on protection and personal data processing

According to Article 13 Act 1-2 and Article 14 Act 1-2 of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC (general regulation on protection data) (Official Journal of the European Union L 119, p. 1) - hereinafter referred to as RODO - we would like to inform you that:

2. Aims and terms of your personal data processing

Your personal data will be processed in order to:

  1. performance of the contract concluded with the Seller, hereinafter referred to as the Agreement Administrator, as well as requesting your actions before its conclusion, in particular answering inquiries regarding the services and goods offered (basis: Article 6 paragraph 1 letter b of the RODO),

  1. fulfillment of legal obligations incumbent on the Administrator, in particular those resulting from the Accounting Act – in order to fulfill reporting and accounting obligations (basis: Article 6 (1) (c) of the RODO),

  1. resulting from the legitimate interests of the Administrator: conducting direct marketing of goods or services and for the purpose of establishing, defending and pursuing claims (basis: Article 6 paragraph 1 point f) of the RODO)

In other cases, your personal data will be processed only on the basis of the prior consent for the purpose and scope of the consent.

3. Information on obtaining your personal data:

The administrator receives your contact details directly from you (eg. when you use our services or purchase goods) or through other people (eg. other intermediaries in offering our services to which you have shared your data). In the case of direct contact, you have full control over the scope of data made available to the Administrator. If the data is shared by another person, the Administrator usually collects only the basic contact details including: name, surname, e-mail address, telephone number and possibly other data resulting from the contract or order in connection with which the personal data is made available.

4. Information about recipients of personal data

The recipients of your personal data may be subcontractors to the Administrator, entities providing accounting services to the Administrator,

IT, advertising, marketing, auditing, advisory, legal, transport and courier.

5. The period during which data will be stored

Your personal data will be processed for the period necessary to perform the contract, as well as for the period in which claims may be disclosed related to this contract, and also for the period required by applicable law in connection with the need to comply with tax obligations.

6. Information about your rights:

You have the right to:

a. request access to your personal data (including to obtain a copy),

b. request correction of your personal data if the data is incorrect or incomplete,

c. request removal of your personal data (“the right to be forgotten”) if one of the following circumstances applies:

  • data are not necessary for the purposes for which they were collected or otherwise processed,

  • the data subject has withdrawn the consent on which the processing is based and there is no other ground for processing,

  • the data subject has objected to the processing,

  • data is processed unlawfully.

  • data must be removed in order to comply with the legal obligation,

d. requests to limit the processing of your personal data if one of the following applies:

  • the data subject questions the accuracy of personal data,

  • data processing is unlawful and the data subject opposes deletion, demanding a restriction instead,

  • the administrator no longer needs data for his purposes, but the data subject needs them to identify, defend or pursue claims,

  • the data subject has objected to the processing of data – pending determination of whether the legitimate grounds on the part of the administrator override the grounds of objection,

e. transferring your personal data, if:

  • processing is carried out on the basis of the consent of the data subject or on the basis of a contract concluded with such a person,

  • processing is carried out in an automated manner,

f. object to the processing of your personal data in the event that:

  • there will be reasons related to your special situation,

  • data are processed on the basis based on art. 6 sec.1 f i.e. necessity for purposes arising from legitimate interests pursued by the administrator

To the extent that you consented to the processing of your personal data, you have the right to withdraw your consent to the processing of your personal data at any time without affecting the legality of the processing that was made on its basis prior to your withdrawal.

7. Information on the right to file a complaint to the supervisory body:

You have the right to lodge a complaint with the supervisory body (ie the President of the Office for Personal Data Protection), if, in your opinion, the processing of personal data violates the provisions of RODO.

  1. Information or provision of data is a statutory / contractual requirement / condition for the conclusion of the contract / obligation to provide data:

Providing the data is voluntary, however, the lack of data by you will be an obstacle to entering into a contract and rendering services to you.

  1. Transfer of data to a third country (ie outside the European Economic Area) / international organization:

Your personal data will not be transferred to a third country (ie outside the European Economic Area) or an international organization.

10. Information about automated decision making:

Your personal data is not subject to automated decision making, including they are not profiled.
